EXPERIENCE

 

David S. Smith provides legal services in maritime matters to various corporate and individual clients engaged in maritime commerce.  Additionally, Dave provides legal advice to many different types of business entities throughout Massachusetts in corporate formation, risk assessment, contracts, negotiations, and litigation.  In terms of litigation, the types of cases Dave handles include: contract, vessel arrest, charters, collisions, partnership disputes, real estate, environmental clean up matters and insurance coverage issues.

 

Having graduated as an engineer from Massachusetts Maritime Academy and sailed for several years, upgrading his U.S. Coast Guard 3rd Engineer’s License (Steam and Diesel Propulsion, Unlimited Horsepower) to a 2nd Engineer’s License (Steam Propulsion, Unlimited Horsepower), Dave lends an uncommon perspective to clients of Ouellette & Smith, P.A.  His unique maritime education and practical work experience have proven to be an invaluable combination in representing various clients involved in the marine industry.

 

Dave is admitted to practice before the courts for the Commonwealth of Massachusetts, the United States District Court for the District of Massachusetts, Maine and Vermont, the United States Court of Appeals for the First Circuit and the courts for the State of Maine.  He is a member of the Maritime Law Association of the United States and holds Proctor status.  He is also an associate member of the Massachusetts Marine Trade Association. 

 

New England Law | Boston has added Dave to its Adjunct Faculty.  He is a Lecturer on Law for a three credit Admiralty Law course.  He has also lectured on Massachusetts Abandoned Vessel statute for the Massachusetts Marine Trade Association.  Additionally, he has lectured on the difference of Salvage and Towing for the Blue Water Sailing Club and United States Power Squadron.

 

In January of 2007, Dave co-founded Sail Salem, Inc. which is a charitable educational organization created to provide a fun, safe, and accessible environment that provides positive life skills such as integrity, sound judgment, teamwork and environmental awareness through the sport of sailing.  The goal of Sail Salem is to offer sailing and youth enrichment programs to any child in Salem and the North Shore of Massachusetts for $1.00.  www.sailsalem.org. 

 

Dave is also the CFO of the Massachusetts Maritime Academy Alumni Foundation.  The Foundation is an independent not for profit 501(c)(3) corporation with a stated purpose of providing assistance to Massachusetts Maritime Academy which typically comes in the from of cadet merit scholarships.
